A few months later my trailer flipped on Stone Valley Road.  I called my Mormon Home Teacher from Alamo 1st Ward who helped get the trailer off the road. 

The next morning I came back to fix the hitch to discover the Mormon Elders and the Home Teacher removed my documents.

Springville • Police on Saturday night said a couple and their three children were found dead in a home here.
The names of the deceased were not immediately released. The home, a duplex, is near 900 S. 1000 East in Springville.The residents on the other half of the duplex were unharmed.
Springville police Lt. David Caron said a medical examiner will determine what killed the family.
"Right now there’s no known cause of death," Caron said at a 9:45 p.m. press conference in front of the duplex. "There’s nothing obvious."
Caron said firefighters tested the air and did not find any carbon monoxide, but the gas could have ventilated before the test.
"This time of year, it’s obviously something we’re concerned with," Caron said of the possibility of carbon monoxide.
The parents were ages 36 and 37, Caron said. Two boys were ages 14 and 11 and a girl was 12.
Another relative spoke to family on Saturday morning, Caron said. When that relative went to the house shortly before 8 p.m., the family was dead. That relative called police.
Springville is on the southern half of Utah County. The county’s bedroom communities have been the scenes of unusual deaths and grisly discoveries this year.

The gig was about building a testing platform for their Supermax product and Sony America.  Max wasn't ready as the main developers biggest shortcoming was he didn't know referential integrity so instead used Triggers to add related records.  They gave me this truly pathetic test model of one screen at a time which bypassed the issues that couldn't be seen.  One was the repetitive automated steps revealed RI Problem, that revealed my

On Scene 

In 2004 there were fire engines and police officers, there were at least 10 calls to 911 and probably a hundred witnesses.   There was an attempted murder and there is no record of this incident.  

I was always curious why the Motorcycle Unit arrived so promptly as in less than five minutes.  For many years I've complained about this incident as I've said from the beginning it was arson but the responding officer didn't take my complaints seriously. 

This officer returned to Walnut Creek in 2012 after I'd been calling everyone which includes San Ramon Fire Protection District and working with the Threat Assessment Unit (Info Popup)

CA: Commission on Judicial Performance

Council on Judicial Performance

This state agency is responsible for setting issues with Judges procedural issues, performance and hearings plus personal issues with Judicial Members.  I happen to have met several of judges over the years and some have stellar records but in my particular incident - one member failed to take my complaints seriously e.g. arson and attempted murder.

We both know the same attorneys, police officers and  court staff.  In 2004 my F-250 burst into flames on 680 but there is no police report, no fire investigation and then more assaults.  Subsequently there were two Gas Line Explosions in 2004 and 2010 with billions in damages, billions in insurer losses and over 15 deaths connected to each explosion.

CJP Complaint Process 

My complaints currently being formulated will likely have greater impact on cases, fines and other judicial proceedings than any other complaints filed undermining decades of convictions. In San Jose a Police Officer raped a homeless woman but when she brought forward her complaint for damages everyone with responsible authority deliberately omitted the victims constitutional rights - to redress the damages with remedy against the city.  The public officials have fallen into a unexpected trap of violations of due process and unexpected theoretical application of the Hobbs Act which ensnared Commander Norman Wielsch convicted in May 2013.  Did San Jose Officials violate the Hobbs Act which would supersede state law?  

My complaints and events precede several cases connected to the CNET Scandal and several devastating Gas Line Explosions.  In 2004 persons with links to CNET tried to kill me for my life insurance and I'm positive that Butler's reduced sentence was him giving up decades of insurance fraud that has found it's way through numerous courtrooms.

Pete Bennett - The Homeless Constituent - Living in Every City, Town and County

In 2003 I had solid clients, projects and plenty of work but in 2010 right after the PG&E Gas Pipeline Explosion a PG&E Engineer and a San Francisco Police Officer (Ret) were in my offices.  within weeks I was running then driven from Walnut Creek ending homeless in San Francisco.
Three years later PG&E is being indicted and my laptop with filled with thousands of pages of PG&E Documents was breached but a PG&E Vendor hired me in Feb 2011 to work on the most sensitive litigation in the Country - the San Bruno Explosion that killed eight, destroyed a neighborhood and left a city screaming for help. Like me they've been screwed over.

In my case my challenges led to Police Officers now in Federal Prison who've been given tremendous overwhelming assistance from Attorneys within the system comprised of City and County Counsel, access to Medical Care, protected by shield laws known as POBOR plus the Risk Managers within the Joint Powers Association, the Municipal Pooling Authority all in essence are co-conspirators who have failed to detect the fraud cases and should have acted long ago with even the remotest suspicion of fraud.

In my calls to elected officials I've been endlessly rebuked, blown off and given the run around.  With each incident I fall deeper in debt, deeper into despair and deeper into the California Gulag.  
While my elected officials called the Police, fined me and beat me up someone in parallel has been killing witnesses, suspects, persons related to Attorneys, Public and Elected Officials and

When State Senator Mark DeSaulnier called the State Police back in August 2011 little did I realize how deep his union connections were but more important how those same unions have permeated every part of my life where this constituents civil rights are continually exploited.
 
For those outside of Contra Costa County a local CNET Police corruption story has impacted the lives of thousands.  When the arrests occurred in March 2011 a familiar set of faces appeared in the news.
The unexpected arrests and subsequent litigation, trials and ongoing revelations revealed that my connections to these persons began in the early 1980's which formulated one core conclusion - the depth of their activities started long before November 2010 as per Contra Costa District Attorney Mark Peterson stated.  Mr. Peterson was fully informed of the attacks on me, my business and my family long before CNET was disbanded.

What's been learned since the arrest lead to common set of actors. Below are groups or incidents meeting the evidence test of the Hobbs Acts for which former Task Force Commander Wielsch was convicted of in 2012.

ANKA Services - Not Every Homeless Person is on Drugs

Drug Counseling 

When the first of many tickets arrived I was astounded at the endless traffic stops, the unlawful searches, stops and baseless allegations of theft, drug sales and possession of stolen property.  That pattern followed me over the Contra Costa County Superior Court where Judge Joel Gulob heard my scenarios of being beaten by a Danville Building Inspector but Joel had children at same schools my sons attended which was Green Valley Elementary School in Danville.

Instead of getting a fair judgment Joel slammed me with fines that are now $15,000 or more.  That was a show stopper as by 2008 my license was suspended and the bank came for my van.  Thanks another unionized County Employee at Child Support a staffer there deliberately lost my paperwork.  Please add $9,000 for repossessed van.

Then over at ANKA Services I spent 18 months following the party line, sitting in drug rehab classes that I didn't need presented by another recovery.  Over and over I stated I was not on drugs.  The ANKA system is about one size fits, fee generation and self-serving interests again administered by unionized county workers.  Much of has happened to me could easily be a Anti-Trust where the officers, judges and county staff all know the value of each ticket so the automatic Civil Assessment Fee which can be manipulated stacks up against the constituent.

The system works we're on Welfare

The Unionized Homeless Court

Since we're homeless that means we are living below the Poverty Line where we've all been convicted via Trial By Declaration in Absentia based on Penal Code section 1214.1(b) which allows a ten day notice which turns to whammy bammy fines.  

One aspect of homeless is getting your mail. The unionized workers who most likely rarely get fines or tickets have homes, income and cars.  There is no way they get the same deal as the rest of us. The forgiveness model is worthless when you're struggles are food, transportation and shelter. 

It's the first ever Poverty Maker Fine - fine em' until you've bled them dry. 


The Collections Business Model 
AllianceOne.com is the place to go to pay off the man.  You had a run of bad luck, you didn't have money when you should have, you failed to appear or more likely is you apparently gave up.  

You should invite your Assembly Member or State Senator to attend your next hearing so the can watch you get economically slaughtered but if you're on food stamps make sure you tell the judge and your elected officials.  Most don't listen as they're planning to be at the next banquet.  


A preliminary check reveals over 600,000 residents in collection and so a one minute error has cascades to a harsh inequitable sentence now lasting over ten years with at least another seven on my credit report. But the omnipetent CalPERS kids go to the best colleges, schools and we're their personal piggy bank. My issues are different my adversaries are cops in prison.

This one size fits all policy is a joke.  The staff lack credentials but clearly after attending the homeless hoedown summer 2012 absolutely every person I connected with never followed up.

It's bad enough getting completely screwed by Judge Golub but looking at the historical issues of murder, arson, extortion and the Hobbs Act Violations that The CNET  Players have additional unidentified suspects aiming to take me down.

I am taking my complaints above the County but since I'm homeless technically any elected official can be called.  I'm either going there or have lived their as I'm the homeless man kicked from one town to the next.

The lost files - after John Newman was murdered in March 2012 I returned to ANKA services vehemently express my concerns about John's murder.  My files vanished shortly thereafter.

Ticketing The Homeless Ensures Homelessness

How Much Is Enough?

The fines can last for 15 years if you're situation is like mine.  Once they send you to collections it sits on your credit report for seven years but my story much different as my story leads to numerous grand jury indictments involving police officers.  

For years I've been targeted by police officer connected to the CNET Players (see links) who operated in a highly coordinated operation known as a clandestine disruption campaign.  These operations completely destroyed my software consultancy, rigged my truck to explode and poisoned yet after nearly a decade I discover a Murder Suicide near that leads to Gas Line Explosions Walnut Creek CA which then discover leads to the same officers, judges and agencies over and over.  

My sons are on welfare, they live in an old formaldehyde trailer which is the perfect arson target, they've while Former Judge Joel Golub lives in Danville, drives a nice car and probably never gets a ticket so I've penned the reality - I'm broke, eating out of trash bins to ensure I don't starve, I've been banned from Trinity Center located in Walnut Creek CA which was over trite issues.  I was essentially told that they don't like me and they don't want me around. 

Their friends over at Hillside Covenant Church are connected to my total wreck and a domestic terrorism breach connected the PG&E San Bruno Fire where eight were killed.

In 2008 I started with the homeless court process over 1120 Detroit Ave, the county is so generous with our money they provide an old cinder block building while they have grand affairs at Scotts Bar and Grill with Prime Rib.

Contra Costa Homeless Court 

There are probably over 25,000 residents caught between living, dying and paying fines which thanks to the clever civil assessment fee my fines is over $16,000.  My choices are pay it but few will hire me with numerous US Grand Jury Indictments near my story and most pass software gigs go down in flames over credit, background checks and your project pedigree.  My history was destroyed by persons calling my clients with threats and it got so bad in 2009 I was forced to take shield all my clients on my resume.

Judge Golub's Court 

This was a dual system court operated in manner with arbitrary policies but my argument about Golub is was fully informed about incidents on my blog.  Reading his biography and background it appears he teach Judicial Procedure.

In addition to my full calendar, I also teach law to Judges at the California Judicial Education Studies Program, teach law to attorneys through the Contra Costa County Bar Association and have taught law students as a professor for more than 20 years.


Officers of the Court 

In the United States, the generic term officer of the court (not to be confused with court officers) is applied to all those who, in some degree in function of their professional or similar qualifications, have a legal part—and hence legal and deontological obligations—in the complex functioning of the judicial system as a whole, in order to forge justice out of the application of the law and the simultaneous pursuit of the legitimate interests of all parties and the general good of society.

Abuse Of Authority

The FBI's website list the garden variety of issues with abuse of the authority but in my incidents they lead directly to several cases, actually many cases with US Grand Jury Indictments but my story also includes beating of Officers of the Court, Constituent Muggings, Vehicle Arsons and lastly deadly explosions and fires.

The CNET Players were sued by me in Bennett v. Collins (2006) in propecia as my Attorney who was not a member of the Contra Costa Bar Association but was a member of the San Francisco Trial Lawyers Association who referred me to a local attorney  who was a Walnut Creek resident.  He was attacked during a basketball game in 2005 and then quickly withdrew.  His safety is still at risk as he's a witness and they are killing witnesses - it's irrefutable that's it's happened but they've killed relatives of Public Officials, Attorneys and witnesses.

Abuse of Authority Under Color Of Law

U.S. law enforcement officers and other officials like judges, prosecutors, and security guards have been given tremendous power by local, state, and federal government agencies—authority they must have to enforce the law and ensure justice in our country. These powers include the authority to detain and arrest suspects, to search and seize property, to bring criminal charges, to make rulings in court, and to use deadly force in certain situations.
Preventing abuse of this authority, however, is equally necessary to the health of our nation’s democracy. That’s why it’s a federal crime for anyone acting under “color of law” willfully to deprive or conspire to deprive a person of a right protected by the Constitution or U.S. law. “Color of law” simply means that the person is using authority given to him or her by a local, state, or federal government agency.
The FBI is the lead federal agency for investigating color of law abuses, which include acts carried out by government officials operating both within and beyond the limits of their lawful authority. Off-duty conduct may be covered if the perpetrator asserted his or her official status in some way.
During 2012, 42 percent of the FBI’s total civil rights caseload involved color of law issues—there were 380 color of law cases opened during the year. Most of the cases involved crimes that fell into into five broad areas:
  • Excessive force;
  • Sexual assaults;
  • False arrest and fabrication of evidence;
  • Deprivation of property; and
  • Failure to keep from harm.
Excessive force: In making arrests, maintaining order, and defending life, law enforcement officers are allowed to use whatever force is “reasonably” necessary. The breadth and scope of the use of force is vast—from just the physical presence of the officer…to the use of deadly force. Violations of federal law occur when it can be shown that the force used was willfully “unreasonable” or “excessive.”
Sexual assaults by officials acting under color of law can happen in jails, during traffic stops, or in other settings where officials might use their position of authority to coerce an individual into sexual compliance. The compliance is generally gained because of a threat of an official action against the person if he or she doesn’t comply.
False arrest and fabrication of evidence: The Fourth Amendment of the U.S. Constitution guarantees the right against unreasonable searches or seizures. A law enforcement official using authority provided under the color of law is allowed to stop individuals and, under certain circumstances, to search them and retain their property. It is in the abuse of that discretionary power—such as an unlawful detention or illegal confiscation of property—that a violation of a person’s civil rights may occur.
Fabricating evidence against or falsely arresting an individual also violates the color of law statute, taking away the person’s rights of due process and unreasonable seizure. In the case of deprivation of property, the color of law statute would be violated by unlawfully obtaining or maintaining a person’s property, which oversteps or misapplies the official’s authority.
The Fourteenth Amendment secures the right to due process; the Eighth Amendment prohibits the use of cruel and unusual punishment. During an arrest or detention, these rights can be violated by the use of force amounting to punishment (summary judgment). The person accused of a crime must be allowed the opportunity to have a trial and should not be subjected to punishment without having been afforded the opportunity of the legal process.
Failure to keep from harm: The public counts on its law enforcement officials to protect local communities. If it’s shown that an official willfully failed to keep an individual from harm, that official could be in violation of the color of law statute.
Filing a Complaint
To file a color of law complaint, contact your local FBI office by telephone, in writing, or in person. The following information should be provided:
  • All identifying information for the victim(s);
  • As much identifying information as possible for the subject(s), including position, rank, and agency employed;
  • Date and time of incident;
  • Location of incident;
  • Names, addresses, and telephone numbers of any witness(es);
  • A complete chronology of events; and
  • Any report numbers and charges with respect to the incident.

FBI investigations vary in length. Once our investigation is complete, we forward the findings to the U.S. Attorney’s Office within the local jurisdiction and to the U.S. Department of Justice in Washington, D.C., which decide whether or not to proceed toward prosecution and handle any prosecutions that follow.
Civil Applications
Title 42, U.S.C., Section 14141 makes it unlawful for state or local law enforcement agencies to allow officers to engage in a pattern or practice of conduct that deprives persons of rights protected by the Constitution or U.S. laws. This law, commonly referred to as the Police Misconduct Statute, gives the Department of Justice authority to seek civil remedies in cases where law enforcement agencies have policies or practices that foster a pattern of misconduct by employees. This action is directed against an agency, not against individual officers. The types of issues which may initiate a pattern and practice investigation include:
  • Lack of supervision/monitoring of officers’ actions;
  • Lack of justification or reporting by officers on incidents involving the use of force;
  • Lack of, or improper training of, officers; and
  • Citizen complaint processes that treat complainants as adversaries.

Under Title 42, U.S.C., Section 1997, the Department of Justice has the ability to initiate civil actions against mental hospitals, retardation facilities, jails, prisons, nursing homes, and juvenile detention facilities when there are allegations of systemic derivations of the constitutional rights of institutionalized persons.
