Pete Bennett a resident of Contra Costa County since 1978 has left numerous requests for police reports. Behind Bennett is a meter reader, a Walnut Creek Police Car and the boot of an officer while he lay bleeding in the street. Bennett was taken to Kaiser for scans when did get the skull fracture, then she noticed the broken collar bone, then the rotator cuff, then she noticed this was the first assualt case based on my charts.

Pete Bennett met Nate Greenan sometime in the early 2000s, they both performed at Vinnies Bar and Grill in Concord. That same week Bennett was arrested where Deputy Vince Jimenez placed a dangerous inmate in his cell then witheld medication of a highly unstable inmate.

Rules of Professional Conduct 3-500 states in part:
"A member shall keep a client reasonably informed about significant developments relating to the employment or representation, including promptly complying with reasonable requests for information and copies of significant documents when necessary to keep the client so informed."
According to the rule, not only must you respond to the client when there are reasonable requests, but you must keep a client reasonably informed about significant developments, even if no requests are made by the client regarding those significant developments. 
Do these significant developments include errors that you have made during representation? Does this include informing your client that you just blew the statute of limitations?
I would state that the answer is yes.
The scary part for the attorney, that just blew a statute, is that the statute being blown might simply be the tip of the iceberg to other ethical violations hidden below.
For example, if you handled your client's personal injury claim perfectly but simply forgot to file the lawsuit to preserve the statute, then you may come out of this without discipline.
However, if you blew the statute, because your office is not well managed, your calendaring system is constantly missing key dates, you haven't called the client back in 7 months after repeated requests to do so, you failed to competently represent the client during the period before the blown statute…you can see how the scenario can change and how discipline is a real possibility.
Some things to think about:
  • You have a duty under Rule 3-500 to provide status to the client regarding their matter. This of course includes keeping them up to speed on significant developments. Another simple example of this would be regarding any settlement offer made by the insurance carrier.
  • If the error you made is a blown statute, then you must inform your client that you blew the statute and that they no longer have a claim against the third party or third parties' insurance carrier.
  • In some states, you are not only required to tell the client the error, but also that the client has a malpractice claim against you. California however, is not one of those states in which you must inform the client about their malpractice claim. (Please see California Rules of Professional Conduct rule 3-410 regarding liability insurance disclosures at the time retained)
  • Prior California ethic's opinions suggest that you have a duty to disclose the error, but not that the client has a valid malpractice claim against you.
  • If you believe you committed malpractice, you must promptly inform the client of the factual information pertaining to the client's claim.
  • Courts have stated that you have a fiduciary obligation to disclose material facts to a client, those include acts of malpractice.
  • You must disclose the facts that surround the error.
  • There can be potential or actual conflicts present if you discuss or advise on the pursuit of the malpractice claim against you. The client should seek independent counsel in order to determine whether or not they have a viable claim against you.
  • If you are thinking about continuing to represent the client, think long and hard about conflicts and what disclosures you need to give the client.
  • A good rule of thumb is to always memorialize any discussion you had with a client. This includes having a written record of your discussion with the client regarding the error.
  • Also, make sure you provide the client with a full and complete copy of their file and give them back any original docs.

Judge Barry Goode - Argument for disbarment, connecting Walnut Creek Police, Contra Costa DA Mark Peterson in Kidnapping Conspiracy

The effective result was aiding and abetting parental abduction of the sons of Pete Bennett but also a co-conspirator in the numerous attempts on Bennett's life.  In 2011, Bennett was followed by Santa Clara District Attorney investigators. 

The most deliberately overlooked incident is when Bennett was traveling north on 680 several months before the deadly Kinder Morgan explosion in Walnut Creek CA.  The divorce started filing was April, by June the explorer nearly flips then another

Barry P. Goode (born April 11, 1948) is a judge in Contra Costa County, California, and a former federal judicial nominee to the U.S. Court of Appeals for the Ninth Circuit.

Early life and education[edit]

A New York native, Goode earned a bachelor's degree magna cum laude and Phi Beta Kappa from Kenyon College in 1969. He earned a law degree cum laude from Harvard Law School in 1972.[1]

Professional career[edit]

Goode's first job out of law school was as a special assistant to U.S. Sen. Adlai Stevenson III of Illinois, from 1972 until 1974, when Goode then joined the San Francisco law firm McCutchen, Doyle, Brown & Enersen (now Bingham McCutchen), where he rose to become a partner. Throughout his 27-year career at the firm, he specialized in representing large corporations in environmental litigation. He also worked as an adjunct instructor of environmental law at the University of San Francisco.[2] Goode left the firm in 2001 to join California state government.

Nomination to the Ninth Circuit[edit]

President Bill Clinton nominated Goode to the Ninth Circuit on June 24, 1998, to replace Charles Edward Wiggins, who had taken senior status.[3] With the U.S. Senate under Republican control from that point until the end of Clinton's presidency, Goode's nomination languished, with no hearing scheduled or U.S. Senate Judiciary Committee vote for him. Despite the support for him from both of California's senators at that time, Dianne Feinstein and Barbara Boxer, Goode's nomination was held up by one anonymous senator who had placed a hold on his nomination for unexplained reasons. Clinton renominated Goode on January 26, 1999, and renominated him again on January 3, 2001.[2] On March 19, 2001, however, President George W. Bush withdrew 62 executive and judicial nominations made by Clinton in his final days as president, including that of Goode.[4] Goode's nearly three-year nomination remains one of the single longest federal appeals-court judicial nominations never given a full Senate vote, behind those of Helene WhiteHenry Saad and Terrence Boyle.
In April 2003, President Bush nominated Carlos Bea to the Ninth Circuit seat to which Goode had been nominated. Bea was confirmed by the U.S. Senate in September 2003.[5]

Work for California Gov. Gray Davis[edit]

On February 1, 2001, California Gov. Gray Davis named Goode as his secretary of legal affairs. Goode called the post an "important job," in an interview with the Metropolitan News-Enterprise newspaper in a story that was published on February 2, 2001. "I'm the kind of person who looks forward, not backward," he told the paper, referring to his expired federal judicial nomination.
During his time working for Gray Davis, Goode was the point person during two controversies. One involved a $95 million software contract with Oracle Corporation and Northrop Grumman that state officials rescinded in 2002 after critics charged that it would cost the state millions of dollars instead of generating the promised $100 million in savings.[6] The other controversy involved power generator Duke Energy, which in 2001 was accused of gouging California.[7]

Appointment to current judgeship[edit]

On November 11, 2003, just days before he left office after an unprecedented recall vote, Davis appointed Goode to serve on the Contra Costa County Superior Court.[8] Goode's courtroom is located in Martinez, California, which is the county seat of Contra Costa County.

Goode lives in California.[1] Goode has taught environmental law at the University of San Francisco School of Law.[1]
