c. ADOPTION OF RESOLUTION approving for authorization to access state and federal level summary criminal history information for employment, volunteers and contractors, in addition to the current California Department of Justice background check.

i. AUTHORIZATION OF THE CITY MANAGER to execute a 2-year purchase agreement with Western States Oil International and Pinnacle Petroleum, Inc. for automotive fuel in an amount not to exceed $340,000 per year with an option to renew such agreement for an additional 2-year period subject to terms established by the City of Oakland and by the State of California Department of General Services.
j. AUTHORIZATION OF THE CITY MANAGER to proceed with the disposition of a portion of the 490 Lawrence Way parcel in exchange for an approximate equal area of land from 2404 North Main Street through a negotiated property exchange in accordance with Administrative Policy No. 80-1.
k. AUTHORIZATION OF THE CITY MANAGER to approve an amendment to the City of Walnut Creek’s agreement with Lifetime Activities for the operation and maintenance of a tennis and pickleball program at Heather Farm Park Tennis Center and other City tennis facilities.
l. APPOINT Frank Napoli to complete the unexpired term of Advisory Council on Aging representative Jessica Thomas for a term ending February 28, 2022.

5. PUBLIC HEARING
a. ADOPTION OF A RESOLUTION APPROVING A PURCHASE AND SALE AGREEMENT AND GRANT DEED FOR DISPOSITION OF A PORTION OF THE JB JOHN PROPERTY AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT WITH BART
The City is the fee owner of a parcel of land located near the intersection of North California Boulevard and Pringle Avenue, which includes a small, triangular-shaped plot within the Walnut Creek BART Station parking lot ("JB John Property"). The small, triangular-shaped portion is residual land currently being used as a landscaped area under the BART aerial overpass within the BART Station parking lot and is less than 5,000 square feet ("Residual Property"). The Residual Property is adjacent to the Walnut Creek Transit Village Project ("Project"), currently being developed at the BART Station. BART and the Project developers desire to incorporate the Residual Property into the Project to accommodate a publicly accessible driveway and utilities to serve the Project, as intended in the vesting tentative map approved for the Project. On February 5, 2019, City Council authorized staff to initiate the process for disposition of the Residual Property for the above-stated purposes in accordance with the "Disposition of Property by Negotiated Sale or Property Exchange" with BART (Administrative Policy 80-1, Section C).  Staff and BART have agreed upon the terms and conditions for disposition of the Residual Property.  The transfer of City’s fee ownership interest will be via grant deed and be effectuated by a Purchase and Sale Agreement to be executed by the City and BART upon Council approval. 6. CONSIDERATION
a. PENSION LIABILITY AND PENSION TRUST PLANNING
Like many cities in California, Walnut Creek’s CalPERS pension liability contributions will increase rapidly over the next several years resulting in considerable pressure on the City’s budget. In preparation for these known increases the City Council directed staff to create an Internal Revenue Service (IRS) Section 115 Pension Trust (Trust) in February 2018. Use of funds invested in the Trust are restricted for use in addressing pension costs. The City Council will receive a report from Bartel Associates, LLC and will be asked to provide direction and/or guidance on the City’s goal to invest in the Trust and plan to use the Trust. b. FISCAL YEAR 2020-2022 BUDGET DEVELOPMENT PLANNING
Government Finance Officers Association (GFOA) and other governmental advisory organizations (such as the Institute for Local Government) provide guidance on local government budgeting best practices, including planning for long-term fiscal sustainability, enhancing transparent and engagement, and preparing for fiscal challenges. As the City begins to experience the fiscal impact of CalPERS pension cost increases, it is appropriate to take the next steps in building upon the City’s fiscal sustainability. At this meeting, staff will provide additional detail in regards to the FY 2020-2022 budget development plans and will seek Council guidance on the proposed action plan.
