The Anatomy of Public Corruption

Senator Mark DeSaulneir Endorsements

Senator Mark DeSaulneir Endorsements

Bennett/DeSaulnier History

In Spring 1981 I was contracted to Hobie Taylor to help build his new restaurant known as Hobies Roadhouse. We had a lot fun building out this location as Hobie brought me along to help buy auction items from England and Europe where the destitute

from over there were selling their antiques cheap. The containers were loaded with gem after gem ranging from lamps, fountains, chandeliers and all types of antique furniture. The tables had barley turned legs, hatched patterns, acorns and endless designs consisting of hand carved serpentines, inlays and gingerbread designs.

March 15, 2010 and Piedmont

On March 15th, 2010 I reached out to the Senator for help with an ever complicated legal nightmare surrounding me. I was targeted by police officers now connected to the CNET Scandal. My story started in 2004 in Danville where I wrote endless letters to the City Council. Down there they could have cared less that my truck exploded on 680 nor did they care that a Danville Building Inspector nearly killed me a month later and that Officer Lombardi took out his service revolver and pointed it at my head.

2004 - Danville Town Council

Arnerich, Doyle, Shimansky, Stepper and the last name eludes me at this writing.

2005 ~ poisoned with either bacteria or poison but Contra Costa Regional Medical Center refused to start an investigation which given that Shimansky, Pollacek, Bell died from Spinal Meningitis and then myself and Supervisor Glover nearly died from similar maladies it's pretty easy to consider that the Doc's Pharmacy fatalities and sickened patients could have another targeted event.

California Poormans Tax - a/k/a The Merry Jerry Brown Tax

Heading

View details »

It's Not a Fine It's A Tax

Please be extremely careful in your driving and car registration & insurance matters. State of California is broke and they are trying hard to squeeze all of us hard to collect money.

Effective immediately, if you do not stop at the red light, be ready to pay $436 in fines or if you pass a school bus with flashing red signals, you will be charged $616. The state of California is going for blood, so be extra careful in driving, You cannot afford messing with them. I have been hearing that Highway Patrols are under pressure to issue a lot more tickets than last year with at least 30% increase in fines over 2009, so beware of radar guns, highway and traffic cameras installed everywhere and the tougher enforcement of parking rules.

Just for your info, the next time you park in the handicapped zone, even for a minute, you will be looking at almost $1000 in parking tickets, so it'd better be worth it. California needs money, so pay close attention to the rules of the road!

Traffic Ticket Fines (Effective 01/06/2011)

VC 12814.6 $214 Failure to obey license provisions.

VC 27400 $178 Headsets or Earplugs covering both ears.
VC 27803 $178 Violation of motorcycle safety helmet requirements.
VC 34506 $616 Commercial Driver - Log book violation.

Look out for the money grabbers in Sacramento but don’t blame the cops. They don't set the fines or collect them!

The Unfair No-Win Traffic System ~

A Direct Challenge

The unfair advantage over the disenfranchised, disadvantaged and unlucky are simply run over by the system. Their rights sold off to AllianceOne.com who summararily put the debt on your credit.

With over 600,000 outstanding tickets they've essentially damaged the buying power of nearly 8% of the residents.  The downside of fining us to bankruptcy is they are impacting our credit ratings placing hidden costs on Constituents.

I've personally made hundreds of calls to my elected officials about my incidents with no luck, no help and Senator Mark DeSaulnier called the Threat Assessment Unit.

I'd be curious to see how many Public and Elected Officials have been fined $16,000 for tickets.
 The elected live well, they live in the finest houses and they are often friends with the judges. I know this personally with Judge Joel Golub who offered the undocumented workers steep discounts. One day in court he chopped identical fines to mine to $75.00 then but added a $2,000 Civil Assessment to my identical ticket.

Food Stamps and Dumpster Diving for CalPERS.    To offset crushing debts I defray expenses by eating from dumpsters which after the September 2013 hit and run leaving me out of bandwidth.

The common answer from elected officials is there is nothing they can do.

When the first arrests of the CNET Players occurred in March 2011 it was clear that Attorneys, Judges, Police Officers, Officers of the Court and many county agencies had ganged up on me.

Tickets CalPERS Members?

Being near the court system, police and different public events over the years I've often noticed the Official Business Card facing the the Drivers license at check out lines or overheard someone boasting they have a friend who is this or that.

My other tactical move is say hello where all too often learn I'm chatting with a public employee.   In my story longer observation in the court room the most unrepresented person is the public employee. The court room is loaded with persons on welfare, SSI or simple lost their job.

In the end they're forced choose between food and fines.  The obvious choice is not to starve to death but obvious problem is the fine goes from 300 to in my case nearly $3,000 per ticket.

You can rest assured this means my life goes nowhere, job options are limited for many and the vast majority of jobs require a license.

Homeless Courts

The concept of a homeless court is to give a fresh start on getting past the tickets and fines.  As this portion of the blog grows I'll share the endless stonewalling I endure for tickets, fines, the court and the endless obstacles and other face.

The State Of California has the No-Win Traffic System that has cost Butte County over $500,000 to take care of my sons while down in Contra Costa County the CNET Players and related investigators targeted my clients, offices and friends.

Judge Joel Golub who in early September 2014 decided to appear at the Walnut Creek Library where the Walnut Creek Police were called my questioning is near zero coincidence of sitting on the same row I'm stuck on while still fighting for license ten years later.

Read more about my personal opinion of what Joel knows as he was once my neighbor and whose been killed in out old neighborhood but more important is we both know the same officers who could have been stopped in 2004 not 2011 and with the recent arrest of now former officer Greg Thompson a black women in Richmond would have been avoided.

Abuse Of Authority

The FBI's website list the garden variety of issues with abuse of the authority but in my incidents they lead directly to several cases, actually many cases with US Grand Jury Indictments but my story also includes beating of Officers of the Court, Constituent Muggings, Vehicle Arsons and lastly deadly explosions and fires.

The CNET Players were sued by me in Bennett v. Collins (2006) in propecia as my Attorney who was not a member of the Contra Costa Bar Association but was a member of the San Francisco Trial Lawyers Association who referred me to a local attorney  who was a Walnut Creek resident.  He was attacked during a basketball game in 2005 and then quickly withdrew.  His safety is still at risk as he's a witness and they are killing witnesses - it's irrefutable that's it's happened but they've killed relatives of Public Officials, Attorneys and witnesses.

Please read my posting called "The Early Witness Termination Fee - don't enter court without it.

Abuse of Authority Under Color Of Law

Color of Law Abuses
Gavel
U.S. law enforcement officers and other officials like judges, prosecutors, and security guards have been given tremendous power by local, state, and federal government agencies—authority they must have to enforce the law and ensure justice in our country. These powers include the authority to detain and arrest suspects, to search and seize property, to bring criminal charges, to make rulings in court, and to use deadly force in certain situations.
Preventing abuse of this authority, however, is equally necessary to the health of our nation’s democracy. That’s why it’s a federal crime for anyone acting under “color of law” willfully to deprive or conspire to deprive a person of a right protected by the Constitution or U.S. law. “Color of law” simply means that the person is using authority given to him or her by a local, state, or federal government agency.
The FBI is the lead federal agency for investigating color of law abuses, which include acts carried out by government officials operating both within and beyond the limits of their lawful authority. Off-duty conduct may be covered if the perpetrator asserted his or her official status in some way.
During 2012, 42 percent of the FBI’s total civil rights caseload involved color of law issues—there were 380 color of law cases opened during the year. Most of the cases involved crimes that fell into into five broad areas:
  • Excessive force;
  • Sexual assaults;
  • False arrest and fabrication of evidence;
  • Deprivation of property; and
  • Failure to keep from harm.
Excessive force: In making arrests, maintaining order, and defending life, law enforcement officers are allowed to use whatever force is “reasonably” necessary. The breadth and scope of the use of force is vast—from just the physical presence of the officer…to the use of deadly force. Violations of federal law occur when it can be shown that the force used was willfully “unreasonable” or “excessive.”
Sexual assaults by officials acting under color of law can happen in jails, during traffic stops, or in other settings where officials might use their position of authority to coerce an individual into sexual compliance. The compliance is generally gained because of a threat of an official action against the person if he or she doesn’t comply.
False arrest and fabrication of evidence: The Fourth Amendment of the U.S. Constitution guarantees the right against unreasonable searches or seizures. A law enforcement official using authority provided under the color of law is allowed to stop individuals and, under certain circumstances, to search them and retain their property. It is in the abuse of that discretionary power—such as an unlawful detention or illegal confiscation of property—that a violation of a person’s civil rights may occur.
Fabricating evidence against or falsely arresting an individual also violates the color of law statute, taking away the person’s rights of due process and unreasonable seizure. In the case of deprivation of property, the color of law statute would be violated by unlawfully obtaining or maintaining a person’s property, which oversteps or misapplies the official’s authority.
The Fourteenth Amendment secures the right to due process; the Eighth Amendment prohibits the use of cruel and unusual punishment. During an arrest or detention, these rights can be violated by the use of force amounting to punishment (summary judgment). The person accused of a crime must be allowed the opportunity to have a trial and should not be subjected to punishment without having been afforded the opportunity of the legal process.
Failure to keep from harm: The public counts on its law enforcement officials to protect local communities. If it’s shown that an official willfully failed to keep an individual from harm, that official could be in violation of the color of law statute.
Filing a Complaint
To file a color of law complaint, contact your local FBI office by telephone, in writing, or in person. The following information should be provided:
  • All identifying information for the victim(s);
  • As much identifying information as possible for the subject(s), including position, rank, and agency employed;
  • Date and time of incident;
  • Location of incident;
  • Names, addresses, and telephone numbers of any witness(es);
  • A complete chronology of events; and
  • Any report numbers and charges with respect to the incident.
You may also contact the United States Attorney’s Office in your district or send a written complaint to:
Assistant Attorney General
Civil Rights Division
Criminal Section
950 Pennsylvania Avenue, Northwest
Washington, DC 20530
FBI investigations vary in length. Once our investigation is complete, we forward the findings to the U.S. Attorney’s Office within the local jurisdiction and to the U.S. Department of Justice in Washington, D.C., which decide whether or not to proceed toward prosecution and handle any prosecutions that follow.
Civil Applications
Title 42, U.S.C., Section 14141 makes it unlawful for state or local law enforcement agencies to allow officers to engage in a pattern or practice of conduct that deprives persons of rights protected by the Constitution or U.S. laws. This law, commonly referred to as the Police Misconduct Statute, gives the Department of Justice authority to seek civil remedies in cases where law enforcement agencies have policies or practices that foster a pattern of misconduct by employees. This action is directed against an agency, not against individual officers. The types of issues which may initiate a pattern and practice investigation include:
  • Lack of supervision/monitoring of officers’ actions;
  • Lack of justification or reporting by officers on incidents involving the use of force;
  • Lack of, or improper training of, officers; and
  • Citizen complaint processes that treat complainants as adversaries.

Under Title 42, U.S.C., Section 1997, the Department of Justice has the ability to initiate civil actions against mental hospitals, retardation facilities, jails, prisons, nursing homes, and juvenile detention facilities when there are allegations of systemic derivations of the constitutional rights of institutionalized persons.
