The murder suicide of Walter Little former Safeway and Southern Pacific murder suicide who was have alleged to have killed his girlfriend during a dispute. Safeway was one of many customers of Mainframe Designs and Fixtures, a large 10 plus man operation and the witness murder in Bennett v. Southern Pacific simply deifies explanation.

The folks at TPG will have to answer to my Whistleblower Complaints on the truly odd collection of RFPs emanating from companies connected to Richard Blum, William McGlashan, CBRE, Regency Centers, Trammell Crow, Lennar, Catellus, Bank of America, PG&E and many more.


Pictured below is William McGlashan now the former Texas Pacific Group (TPG) fired from TPG Growth after his indictment and arrest.


My story is about witness murders, private equity, mergers and acquisitions linked back to the Matter of Bennett v. Southern Pacific lost in 1989.  It was a winnable case as long the witnesses testified.

You may recall the sad story of Brandon Marshall, which I wrote about last September: The 43-year-old quality assurance engineer, who had a history of mental illness, was fatally shot in December 2013 by a sheriff’s deputy outside his workplace at Roku,the
set-top device maker.


In the litigation that followed, the chronology did not look good for Santa Clara County. Marshall, who had furiously ingested pills that morning and was described as acting “manic,” was negotiating with a paramedic to get help when deputies arrived at
the Saratoga site.



The deputies say he swung a key fob, or “kubaton,” at them before Deputy Aldo Groba fired a shot at the engineer’s stomach. His family’s attorneys contend that the deputies had no reason to confront Marshall, who posed no significant threat: He was simply
waving his keys in his agitation.
Among the heartbreaking details was that Marshall’s father, Steven Marshall, was on the telephone with the paramedic when he heard his son cry out from the shot. Brandon Marshall died several hours later at Valley Medical Center despite desperate attempts
to save him.
Now, from filings by the family’s attorney, James McManis, several more details have emerged about the case. And little of it strengthens the county’s position. Here are a few key points:
A) None of the four deputies who responded to the scene had CIT (crisis intervention training), which teaches authorities how to deal with the mentally ill. Like many departments, the sheriff’s office offers such training but does not make it mandatory.
B) Brandon Marshall showed signs of delusion that morning. He insisted that unknown gunmen were training guns on him from above. He referred repeatedly to the Secret Service and told bystanders that he needed help.
C) When the first deputy on the scene, Kristen Anderson, approached Marshall, he became more agitated. His family’s attorneys say he was fidgeting with his keys, which were attached to a thin, rounded aluminum rod. When Anderson asked if it was a weapon,
Marshall said it was and put it away at her request.
D) Groba initially had been standing some distance away when Anderson — according to the family’s filing — looked over at him. Groba then approached with a gun drawn, prompting Marshall to back up and say, “No, no, no” or “whoa, whoa, whoa,” witnesses
said. As Marshall swung his key chain at deputies, Groba fired a single shot.
E) After he fell from the gunshot, the deputies put the injured Marshall’s hands behind him and knelt on his back, causing more pain to the engineer. The deputies refused a request from the paramedic to treat Marshall until they had restrained him.
It’s important to understand that the bulk of this, although based on police reports and interviews, represents one side of the case. The county says it does not expect to file its detailed response until August. County Counsel Orry Korb told me by email
that the county does not comment on pending litigation.
But it is clear that the defense wants to portray the key fob as a weapon. “It is undisputed that Marshall attacked Groba” with a kubaton, said one filing by the county. “Groba fired a single shot from his service weapon in response to the attack.”
Just exactly how Brandon held that key fob — and how it was shaped — are crucial elements in this case. So, too, is the testimony of the paramedic who was negotiating with Marshall’s father to get the troubled engineer a ride to the hospital.
“This guy had a key chain,” said family attorney McManis. “They’re trying to turn it into a weapon. But the fact of the matter is that the only thing he did was hold on to the business end of the fob and wave his keys around. And they gun him down. To
me, it’s appalling.”

an inch (1.25 centimetres) in diameter, slightly thicker or the same size as a marker pen.

Todd Cambra banned from Trinity Center froze to death, then John Dullich lost his life the same way the next day and Rhonda found murdered in Las Trampas Creek.  Back in 2009, Adam Milford was found just in San Ramon creek in front of Los Lomas High School and just down the road on Creekside was former Starbucks employee who finished his cosmetology training was splitting time between Starbucks and Salon Amore.




This man has been hit seven times within a 1/4 square mile of Traders Joes in Walnut Creek - deeper in the tape he states he landed on the windshield. Then two months after I interviewed him he was hit again - he's still alive - his July 11th accident

and mine was July 20th but wait there is more - we get free lunches served in Walnut Creek every Monday Civic Park Walnut Creek near the senior center. It's amazing as our other friend was murdered, and at least five others
are have been hit by cars. No one is listening and sooner or later will be killed in a hit and run, Marcus B. and Todd C. are in long term care and John Newman on March 30th 2012, Glen Davis Clayton Road Concord

The Miscues and the Murder of Officer Lester Garnier


I landed here in Walnut Creek, at St. Paul’s , in November of 2016 for my fourth residenin the six years that I’ve lived in Northern California. I always enjoy moving around and meeting new folks
and being some small part of the beautiful tapestry called the Diocese of California. Since I was already living in the East Bay, I had some ideas about what was happening at St. Paul’s. I did not, however, realize just how big and how amazing the work of St. Paul’s was. 

I am, and I continue to be, blown away by the sheer courage and dedication of this community and what it is that they are accomplishing. St. Paul’s is quietly, and with considerable perseverance, doing the work of God for the people of God, and the story of this work is remarkable.

In a nutshell, St. Paul’s is tearing down two old existing buildings on its property and building St. Paul’s Commons , a four-story facility that will house 45 units of affordable housing and provide new space for Trinity Center’s homeless ministries and meeting spaces for the parish and neighborhood.

The project was the joint brainchild of the Rev. Sylvia Vasquez and Donna Colombo, who is the current director of
Trinity Center . To help make their dream a reality, they enlisted the help of a small group of energetic and inexhaustible folks: Charles Couch, Jennifer Machado, Molly
Clopp, Richard Kemink, Dave Mattern and Julie Layne. Despite their each having full lives outside this ministry, they have been working tirelessly with the developer, Resources for Community Development (RCD)


Though it would be easy to get lost in the details of the history of project and all excellent work involved, I want to focus here on one particular example of change and blessing by lifting up the work Trinity Center Director
Donna Colombo. Donna has changed minds in the city of Walnut Creek and, in the process, changed both the lives of its homeless residents and the people who work to help them. St. Paul's Commons will include 45 units of supportive
housing and space for Trinity Center's homeless program.

 
My first encounter with Donna has marked my memory and my heart with a passion, an energy, and an example of a dogged determination that I don’t often see. When Donna was asked to take over the ministry “next door” that morphed from its beginnings as
Fresh Start into Trinity Center, I am sure that she could not have predicted the journey that was to come or the place that she now finds herself in. I think I began to understand the hard work of this process when I attended
the Walnut Creek meeting of the city planning commission.

As I sat through this lengthy meeting, I heard voices of fear, anger, disappointment, and ignorance. But there were also voices of hope. In fact, supporters of Trinity Center’s much-needed temporary move to another location attended
in overwhelming numbers. Not only had the people of St. Paul’s come out in force, the greater community of church and charitable organizations were also a strong and visible presence.




When I began to investigate some of the back story of this remarkable showing of support, I quickly discovered that the hearts and minds of both political and business members in Walnut Creek had been radically changed through the constant and dedicated work of Donna Colombo and Trinity Center. To a person, the members of the city planning commission voiced absolute support of the mission of Trinity Center and the benefit that this little ministry on Trinity Avenue had been able to provide for Walnut Creek, a city bursting at the seams with growth.


The importance of the hearings with the city planning commission and then the city council was because the physical location for Trinity Center Ministries would have to be moved out of their old buildings at St. Paul’s. In order for the project of St. Paul’s Commons to proceed, these buildings had to go. What would Trinity Center do? Where would they go? How could they continue to serve the most vulnerable if the center itself were homeless too!

Some of the more angry voices in the city meetings had hoped that the location selected as the temporary site would be denied. The level of fear and ignorance about the homeless was jaw-droppingly painful to listen to, but, patiently, the city council listened to each member of the community who needed to speak and hoped to be heard. Patiently as well, Donna and members of the Trinity Board stood and responded; they spoke in understanding, love, and compassion
for all the fear, for all the anxiety, and for all the urgent needs.

When the council entered into its own open deliberations, the reflections offered by each member were consistent and could be summarized this way:

Through the dedicated witness of Donna Colombo, and the exceptional day program being run out of Trinity Center, the city of Walnut Creek is a safer more compassionate city. The example of Trinity Center has softened the hearts and minds of city leaders
who, just a few short years ago, wouldn’t even admit that Walnut Creek had homeless people.

The council members noted that, with Donna’s persistence and dogged determination, the business community of Walnut Creek has rallied to address realistically and head-on the issue of homelessness downtown. With the help of Donna and the work of Trinity
Center, Walnut Creek is able to own its responsibility to those who live on the streets now or who are minutes away from being homeless.

Each member stated clearly that denying Trinity Center its application for this temporary move would be a brutal set-back to efforts to address homelessness and the Bay Area’s housing crisis.

Townsend & Stockton, was shot and killed on his front porch in El Cerrito, California, on Thursday evening. Police said Gilliland, 62, was shot shortly before 9 p.m. as he was returning to his home from a social engagement,
report the San Francisco Chronicle, the East Bay Times, NBC Bay Area and the Recorder (sub. req.). El Cerrito police Lt. Robert De La Campa told the Chronicle it wasn’t known whether Gilliland was stalked or followed, or
whether he was a robbery victim. Gilliland was chairman of Townsend & Townsend & Crew from 2001 to 2010, before it merged and became Kilpatrick Townsend, according to the Recorder. He was chairman of the firm’s
litigation department from 2013 to 2015. His clients included Apple, Oracle and Sony. Kilpatrick managing partner Susan Spaeth expressed condolences and called him “an absolute pillar” of the law firm in a statement published
at the firm’s website. “We are deeply saddened by the death of our colleague, friend and partner, Jim Gilliland,” Spaeth said. “Our most heartfelt condolences and sympathies go to Jim’s family and all of his colleagues,
friends and clients. “Jim was dedicated to his wife, Vickie, his four children and his parents. They were the center of his life. His passions spanned from spending time with his family to singing, enjoying the arts, travel
and sports. “Jim was an absolute pillar of our law firm. He was our trusted colleague and close friend, as well as a mentor and role model to so many. Jim will be missed deeply. He was truly a great lawyer, and his many
clients trusted him with their most difficult cases. Jim had been successfully trying cases in federal and state courts around the country for 35 years. Over his amazing career, Jim led our firm in many ways—as managing
partner, chairman, and most recently served as chairman of our litigation department. “It is truly a great loss for the Kilpatrick Townsend family and the legal community. We offer our thoughts and prayers to Jim’s family
and friends.”

The Gilliland family asks that members of the public and the media continue to respect their privacy during this difficult time. We would like to thank the El Cerrito Police Department and Jim’s friends for their efforts in connection with the investigation.
Our husband and father, Jim Gilliland, was murdered eight months ago – a crime that is yet unsolved. It was an unthinkable act, committed in front of our family home of 32 years in El Cerrito, a community we love. Jim sang in the
church choir for decades, sharing his love of music with each of us. He loved and cheered the San Francisco Giants, the Golden State Warriors, and the Pittsburgh Steelers, the team he grew up with. We cheered alongside him. He
was a big-hearted and warm person, generous with his time and skills to anyone who might benefit. As a husband, he was a true partner in life and his love of our family was paramount. As a father, he was completely involved in
our lives. He coached us in sports, taught us how to drive, came to our music recitals and made us endlessly edit our essays. He supported us in our adventures and helped us with the obstacles that life brings. But he wasn’t there
just for us. He worked tirelessly for the education of underserved communities in Richmond and Oakland. He coached Little League; he served everyone from clients to fellow volunteers with dignity and respect; he worked hard to
make every institution he served a better place for all. He was loved by many. It is hard for us to imagine who would want to kill such a kind and gentle soul. We miss him terribly. We would like others to be spared our feelings
of profound loss, to be spared the sadness and grief we experience every day. Every birthday, Father’s Day, and anniversary reminds us of the father and husband who was taken from us. We ask anyone who can provide any leads or

Since its founding in 1995, Union Bank has achieved steady growth, propelling it to become one of the leading private commercial banks in Sri Lanka. The potential for growth attracted the attention of US-based global investment firm TPG Capital, which invested in 70 percent equity in the Bank in 2014 – one of the largest foreign direct investments in Sri Lanka. Although the reviews themselves were done on a system, the HR team and line managers relied on spreadsheets to consolidate data. These tools not only frustrated both employees and line managers alike, the process resulted in significant delays and left room for error. Most of all, the process did not leave much room for employees to take ownership of their performance, or for line managers to take accountability for their feedback.
In a timely move, Union Bank decided to invest in a performance management tool that was future-proof and supported the business agenda of embedding a performance culture.

Union Bank invested significant time and effort to evaluate several local and global products in order to select the right implementation partner and the right system. After much careful deliberation and backed by the Board of Directors and the CEO, the Bank selected SAP SuccessFactors Performance & Goals as the foundation for its new performance management platform.
The Bank envisioned leveraging the flexibility offered by SAP SuccessFactors to tailor the right performance management tool for employees. This meant that the new tool would change the way employees and line managers experienced the entire performance management lifecycle. In order to optimize the features of the system and deploy the right configuration, the Bank felt it critically important to collaborate with an experienced and competent implementation partner. Nurturing a culture of performance

Supported by the SAP SuccessFactors solution, Union Bank has transformed its approach to performance management, encouraging employees to become more invested in the process. Employees see SAP SuccessFactors as a tool that supports their performance and growth.
Previously, getting anyone to complete assessments was a struggle, and as a result the year-end review often ended up taking significantly longer than it does now. With the much more user-friendly SAP SuccessFactors, employees are much more likely to log on, record their performance assessments and set new goals for themselves.
The Bank recently completed its first year-end performance review, goal setting for the new performance year, and its first interim review using the SAP SuccessFactors solution. Not only was the cycle time to completion reduced by at least 50 percent, the employee and line manager experience of engaging in the performance management process significantly improved as well.
SAP SuccessFactors has useful features that enable the end user to access all the information and resources required for an effective performance cycle. The ease of configuration supports the system to be tailormade to organizational requirements, whilst leveraging its own strengths. In the process of setting up the system, the Bank was able to streamline the entire performance management process. In doing so, with the objective of bringing greater clarity to goals aligned with business directions, the Bank formed its own library of goals, which now consists of 15 department-wise goal libraries.
The system has also been configured to store, access and key in feedback by employees, line managers, and company stakeholders. This provides the opportunity for more holistic performance reviews and feedback. Line managers have the option to gauge team performance, and prepare more objectively for calibration. The entire process, end to end, is perceived as transparent by employees at all levels.
In its journey to drive a performance culture, the Bank has aligned other processes within the employee lifecycle with performance such as compensation and career progression. SAP SuccessFactors is proving to be a useful tool in recording performance feedback in a timely manner so that every employee has a view of their performance and feedback from the line manager.
The greatest success of an implementation is effective change management. Believing that the buy-in to the system and the process would only materialize if their value was cascaded, the Bank ensured that all line managers received training with regard to the new system. Intensive testing was also conducted prior to go-live so that the user experience was absolutely positive from day one.
Union Bank has laid the foundations for the transformation of employee performance management, and is excited to see how the system will support the improved performance management process and experience. The SAP SuccessFactors Performance & Goals solution deployed by IBM has had a very positive impact in a short time, and the Bank is confident that it will help to keep employees energized and performing to the very best of their ability.
