Warrant: CHP officer says stealing nude photos from female arrestees 'game' happened in L.A., Dublin offices

MARTINEZ -- The California Highway Patrol officer accused of stealing nude photos of a DUI suspect from her phone while she was in custody has told investigators such image-stealing has been going on for years in the state law enforcement agency, stretching from its Los Angeles office to his own Dublin station, according to court documents obtained by this newspaper Friday.
CHP Officer Sean Harrington, 35, of Martinez confessed to stealing explicit photos from a second Contra Costa County DUI suspect without her permission in August and forwarding images to at least two other CHP officers. The five-year CHP veteran called it a "game" among officers, according to an Oct. 14 search warrant affidavit. Harrington told investigators he had done the same thing to female arrestees a "half dozen times in the last several years," according to the court records, which included graphic text messages between Harrington and his Dublin CHP colleague Officer Robert Hazelwood.
"There is probable cause to believe that California Highway Patrol Officers Sean Harrington and Robert Hazelwood, and others, both sworn officers and non-law-enforcement persons, engaged in a scheme to unlawfully access the cell phones of female arrestees, by intentionally gaining access to their cell phones and without their knowledge stealing and retaining nude or partially clothed photographs of them," Senior Contra Costa District Attorney inspector Darryl Holcombe wrote. Holcombe wrote that he found probable cause that both officers committed felony computer theft.

The new court documents show Harrington's alleged August nude photo lifting may not be an isolated scheme, and potentially involves more CHP officers around the state. One DUI case has already been dismissed as fallout from the investigation, and a prosecutor has said that any possible charges against officers could throw any cases in which they are witnesses into question.
No charges have yet been filed in the probe; deputy District Attorney Barry Grove said he expects a decision to be made next week.
"It's going to lead to another level of mistrust and skepticism to the motive of law enforcement in general," said Rick Madsen, an attorney representing the first Jane Doe. "This conduct is theft, and theft is defined as a moral turpitude crime that casts doubt one's character to tell the truth.
"The implications as far reaching and very damaging," Madsen added.
"If an officer knowingly received stolen property, in whatever form, then yeah, they are guilty of criminal offense."
As this newspaper first reported, Holcombe wrote in an earlier search warrant that Harrington allegedly forwarded explicit photos of a 23-year-old San Ramon woman from her phone to his own personal phone during a DUI arrest. The woman, referred to as Jane Doe in court documents, only discovered the theft five days after her release, tipped off because her iPad was synced to her iPhone, and she noticed the mysterious photo texts to an unknown phone number. Holcombe, using video surveillance and time-stamped text messages from the woman's phone, determined Harrington was in possession of the woman's phone at the moment the photos were forwarded. The woman -- who registered a blood alcohol level of .29 percent, more than three times the legal limit -- was being processed in the Martinez County Jail early Aug. 29 when the photos were stolen, according to court records.
Investigators first confronted Harrington on Oct. 10 and advised him a woman had made a complaint that her personal property was stolen. He voluntarily agreed to be interviewed. During questioning, Harrington admitted to stealing five photographs from Jane Doe (investigators have said there were six) and that he forwarded at least one to Hazelwood, according to court records.
"Harrington said he first learned of this scheme when he was working in the Los Angeles Office," Holcombe wrote. "Harrington said when he was assigned to the Dublin Office, he learned from other Officers that they would access the cell phones of female arrestees and look for nude photographs of them. Harrington said if photographs were located, the officers would then text the photographs to other sworn members of the office, and, to non-CHP individuals."
The new court documents describe a second incident in which a 19-year-old woman, referred to as Jane Doe #2, was involved in a DUI crash in Livermore on Aug. 7. On Harrington's phone, Holcombe located two photos of that DUI suspect in a bikini accompanied by a text message from the day of the arrest from Harrington to Hazelwood: "Taken from the phone of my 10-15x while she's in X-rays. Enjoy buddy!!!"
A "10-15x" is CHP code for in custody female and the woman may have been at a hospital to take X-rays after the crash.
Hazelwood replies: "No f---ing nudes?"
Shortly after sending to Hazelwood, Harrington sends another Dublin CHP Officer Dion Simmons the bikini photos with the same message indicating they were of an female arrestee. Simmons texts back "Nice" and "Hahahaaaa" and Harrington replies: "Just rerun a favor down the road buddy. :)"
Holcombe also detailed Aug. 29 text messages between Harrington and Hazelwood discussing the six photos he allegedly forwarded of the first Jane Doe in various states of undress, including one with a friend in the photo.
"Nudes are always better with the face," Hazelwood wrote to Harrington, less than an hour after the latter allegedly stole the woman's photos. Harrington replied: "Maybe she knows she has a jacked up horse face?!?!?"
Hazelwood asked to see her "dl," possibly referring to her driver's license photo and Harrington texted back: "When we get back to office. And we'll have MDF (county jail) mug shot too."
The pair continued the text back-and-forth, commenting on her "rocking" body and breasts.
On Oct. 10, after Harrington spoke to investigators, Hazelwood's supervisor ordered him to report to the DA's office. Shortly after entering the interview room, Hazelwood was advised it was a criminal investigation and he could leave at any time. He got up and exited the room.
But as he was leaving, Holcombe -- who said he worried Hazelwood would delete evidence from his phone after the meeting -- noticed a bulge in the CHP officer's back pocket and asked if he could see his cell phone. Hazelwood asked if he had a search warrant, and Holcombe said he did not, but told the officer he will keep the phone while obtaining one. Hazelwood initially consented to the search, but refused to sign the consent form, the investigator wrote.
Four days later, investigators got the warrant and found the text messages between Hazelwood and Harrington and photos of Jane Doe 2 on Hazelwood's Samsung Galaxy S5, according to the records.
Holcombe wrote he is part of an "investigative team" assigned to probe Harrington, Hazelwood and "others."
The CHP did not immediately to a request for comment on this story. Reached by cell phone Simmons declined to comment and a message was left with Harrington and Hazelwood.

Matthew Michael Lyon died unexpectedly Friday evening, July 27, 2012 while on his way to meet Boy Scouts from Troop 820 as they completed a 30-mile backpacking trip on the Pacific Crest Trail.
Matt was born in Salt Lake City on April 16, 1970. He was raised in Pleasanton, California and graduated from Amador Valley High School. He served a two year mission in Guatemala for The Church of Jesus Christ of Latter-day Saints. Following his mission he attended UC Davis where he earned degrees in Economics and International Relations. He married Eleanor L. Valencia on September 15, 1995 in the Oakland LDS Temple. He worked for Accenture for 16 years.

He is survived by his wife Eleanor, children Connor (12), Jordan (9), Maxwell (7), and Sierra (4); parents Michael and Susan Lyon of Pleasanton, brothers Nicholas (Chelsea), Daniel (Holly), and Christian of San Francisco, niece Madison and many loving
aunts, uncles, and cousins.

Matt lived a life of selfless service to others and filled many church roles, including his most recent as the Bishop of the Walnut Creek II Ward. Matt enjoyed exploring the California coast, backpacking, gardening, home improvement projects, and spending
time with his family and friends.  He found beauty in nature, art, music, good literature, and always looked for the good in others.  He touched many lives with his witty humor and easy-going nature. He loved his family above
all and will be missed by all who knew him.
Funeral services will be held Saturday, August 4, 11am with visitation at 10am at The Church of Jesus Christ of Latter-day Saints, 2369 Overlook Drive in Walnut Creek. A shuttle will be available for overflow offsite parking.

NEW YORK, October 24, 2000 – Accenture today announced that Pacific Investment Management Company ("PIMCO"), one of the world's leading fixed income asset managers, has signed a letter of intent to become the first client of WEBeSTP, the straight-through processing (STP) solution that Accenture is developing with industry participants and select service providers for the global investment / asset management community.
WEBeSTP is an Internet portal that will provide financial industry participants with a single automated point of entry for pre-trade, trade and post-trade activities. It will also link customer relationship management and enterprise resource management with real- time portfolio management capabilities. Its primary purpose is to help asset managers and other financial markets players reduce the costs and risks currently associated with the end-to-end process of securities trading.
Working closely with PIMCO, Accenture has defined the asset managers' requirements for a customer relationship management and market-data integration solution. Bloomberg, which announced its participation in WEBeSTP back in June, is working to develop the fixed income portfolio management and order management capabilities.
The securities industry today is being stretched to the limit by record trading volumes, extended trading hours, intense competition, changing customer expectations and the move to T+1 in the United States. A solution to this challenge is STP, an integrated approach to achieving automated, end-to-end trade processing through the trade's entire lifecycle, beginning and ending with the investor.
"From an asset manager's perspective, there are three primary drivers for implementing WEBeSTP – cost reduction, cost avoidance and risk reduction. According to the recently completed SIA T+1 business case, asset managers have the weakest return on investment economics. WEBeSTP is targeted to solve that problem," said Jim Honohan, partner, Accenture. "By leveraging the experience and knowledge of PIMCO and Accenture, we are able to focus specifically on what the asset managers' needs are in implementing an integrated STP solution."

Straight-Through Processing (STP)
STP solutions are needed to help financial markets firms meet the U.S. Securities and Exchange Commission's expected call for one-day trade settlement (T+1), as well as to meet the global demand that has resulted from the explosive growth of online trading. Presently, the entire trade lifecycle, from initiation to settlement, is a complex labyrinth of manual processes, taking several days. STP enables the entire trade process to be conducted electronically without the need for re- keying or manual intervention. When fully realized, STP will provide broker/dealers, asset managers, custodians and other financial services players with tremendous benefits, including greatly shortened processing cycles, reduced risk and lower operating costs.
WEBeSTP
The Accenture WEBeSTP solution was conceived and is being developed at the Accenture STP Center of Excellence, located in New York City. Accenture is in discussions with other select service providers and industry participants regarding their potential involvement in WEBeSTP.

WALNUT CREEK -- A group of 10 women -- most of them in their mid-90s -- dolled up in hats and fancy dresses and prepared to head to Sonoma to celebrate a friend's 96th birthday Sunday morning, escaped injury when their idling limousine burst into flames, according to neighbors and authorities.
Contra Costa County Fire District crews were called about 11:35 a.m. Sunday to Skycrest Drive in the Rossmoor gated community for a vehicle fire. The fire burning the 2009 Lincoln town car was quickly put out, a dispatcher said.
According to neighbor Judy Becker, one of two caregivers on hand for the birthday excursion started smelling smoke.
"I was told she dashed to the doors, and with the other caregiver, started helping out those with walkers and canes, before the fire really erupted," Becker said.
Mary Chapman, one of those in Sunday's limo fire, told ABC 7 News it reminded many of those involved of the deadly May 4 limo fire on the San Mateo Bridge. That fire killed a new bride and four of her friends.
They were grateful the limo wasn't moving or on the freeway when it caught fire, Chapman said.
Walnut Creek police Lt. Lanny Edwards said the department is investigating the circumstances of Sunday's fire, particularly given the "history of what transpired" last month on the bridge. As of Sunday, nothing of a criminal nature had been discovered.

"We've notified CHP of what happened, and we're going to be following up on it," Edwards said.
The owner of the limo, who declined to be identified, told this newspaper Sunday that the fire appeared to have been caused by an electrical problem.
The women made it to the birthday party nonetheless, all traveling in their own cars or having someone drive them.

Alamo man who died in burning vehicle identified

The California Highway Patrol said 60-year-old Michael Sevenau died after the silver 2000 Jaguar he was driving went off the road, hit a tree and caught fire. The wreck happened just after 12:30 a.m. Sunday.

An investigation showed the Jaguar was traveling east on Stone Valley Road and wound up in the west side of the road before colliding first with some mailboxes, CHP Officer John Fransen said.

The Jaguar then spun around, broke through a wooden fence and down a dirt embankment before hitting the tree. Police are still investigating whether drugs or alcohol played a role in the wreck.
Investigators have not yet determined if Sevenau suffered a medical issue while he was behind the wheel. He was pronounced dead at the scene. Contact Rick Hurd at 925-945-4789 and follow him at Twitter.com/3rderh

Springville • Police on Saturday night said a couple and their three children were found dead in a home here.
The names of the deceased were not immediately released. The home, a duplex, is near 900 S. 1000 East in Springville.The residents on the other half of the duplex were unharmed.
Springville police Lt. David Caron said a medical examiner will determine what killed the family.
"Right now there’s no known cause of death," Caron said at a 9:45 p.m. press conference in front of the duplex. "There’s nothing obvious."
Caron said firefighters tested the air and did not find any carbon monoxide, but the gas could have ventilated before the test.
"This time of year, it’s obviously something we’re concerned with," Caron said of the possibility of carbon monoxide.
The parents were ages 36 and 37, Caron said. Two boys were ages 14 and 11 and a girl was 12.
Another relative spoke to family on Saturday morning, Caron said. When that relative went to the house shortly before 8 p.m., the family was dead. That relative called police.
Springville is on the southern half of Utah County. The county’s bedroom communities have been the scenes of unusual deaths and grisly discoveries this year.
